1. Acceptance of Terms
By downloading, installing, or using HotMess Generator ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and HotMess Generator ("we," "us," or "our"). The App is licensed, not sold, to you.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have your parent or guardian's permission. By using the App, you represent that you meet these requirements.
3. Account Registration
You may need to create an account to use certain features. You are responsible for:
- Providing accurate and complete information
- Keeping your login credentials secure
- All activity that occurs under your account
You may delete your account at any time through the Account settings in the App. Upon deletion, all your data will be permanently removed.
4. Description of Service
HotMess Generator is a personal fitness motivation app that allows you to:
- Track weight and body measurement check-ins
- Create a personal story profile with goals, milestones, and lessons
- Generate shareable motivational card packs in various visual styles
- View your progress through charts and history
The App is designed for personal motivation and self-tracking. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
5. Health Disclaimer
The App is not a substitute for professional medical advice. Always consult a qualified healthcare provider before starting any weight loss program or making changes to your diet or exercise routine.
We are not responsible for any health decisions you make based on information displayed in the App. The motivational content generated by the App is for encouragement purposes only.
6. Subscriptions & In-App Purchases
The App offers a free tier and an optional "HotMess Premium" subscription that unlocks additional card pack skins and features.
Payment
Premium subscriptions are processed and billed by Apple (via the App Store) or Google (via Google Play), not by us directly. By subscribing, you also agree to the applicable store's payment terms.
Auto-Renewal
Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's subscription settings (App Store or Google Play).
Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
Free Features
All core features — check-ins, story profiles, card generation, and progress tracking — are available for free. Premium only unlocks additional visual skins for card packs. We do not limit the number of card packs you can generate.
7. User Content
"User Content" means any data you enter into the App, including check-ins, story profile information, notes, and milestone photos.
- You retain ownership of all User Content you create
- You grant us a limited license to store, process, and display your User Content solely to provide the App's functionality to you
- You are responsible for ensuring your User Content does not violate any laws or third-party rights
- We do not claim ownership of your User Content and will not use it for purposes beyond delivering the service
8. Generated Card Packs
Card packs generated by the App combine your User Content with our visual templates and designs. You are free to share, download, and use your generated card packs for personal, non-commercial purposes.
The visual templates, skin designs, icons, and layout elements used in card packs remain our intellectual property. You may not extract, reproduce, or redistribute the design templates separately from your generated content.
9. Prohibited Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse-engineer, decompile, or disassemble the App
- Use automated systems (bots, scrapers) to access the App
- Upload content that is harmful, offensive, or infringes on others' rights
- Circumvent or manipulate the subscription or payment system
- Resell, sublicense, or commercially exploit the App or its content
10. Intellectual Property
The App, including its design, code, graphics, UI elements, skin templates, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks or brand assets.
11. Availability & Updates
We strive to keep the App available and functional, but we do not guarantee uninterrupted access. We may:
- Update the App with new features, bug fixes, or changes
- Temporarily suspend the service for maintenance
- Discontinue the App or specific features with reasonable notice
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability for any claim related to the App shall not exceed the amount you paid us in the 12 months before the claim
- We are not responsible for any actions you take based on content displayed in the App, including health or fitness decisions
13. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.
Upon termination, your right to use the App ceases immediately. Sections regarding liability, intellectual property, and dispute resolution survive termination.
14. Dispute Resolution
If you have a dispute with us, we encourage you to contact us first at support@hotmessgenerator.app so we can try to resolve it informally.
These Terms are governed by applicable law in your jurisdiction. Nothing in these Terms limits your statutory consumer rights.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other means before the changes take effect. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
